Two Questions:
1. Why can’t we seem to regulate “the aggressive and unethical marketing of breast milk substitutes” in the country if it doesn’t promote the well being of our infants?
2. Who is really to blame in the deaths of thousands of babies as pointed out by the World Health Organization (WHO)?
On question number one, the answer is clear and simple because there is no law that is powerful enough to regulate the proliferation of infant formulas backed by powerful advertising and multi-national companies.
Ask yourself why is this bad for the country and for its babies? What is the socio-economic class where all the victims of bad advertising and marketing resulting to infant fatality belong to? Is media partly to blame for the deaths of thousands of infants?
Which brings us to the second question which is primarily concerned with giving the responsibility towards certain parties concerned.
There are four parties involved: One the Government, Two the Health Sector, Three the Media and lastly the Milk Companies.
Upon passing of the Milk Code, The Government rested on the capability of the Health Sector to look out for itself amongst others giving them authority to watch over media and milk companies, however which by its own E.O. 51 it is never powerful enough to file cases against Milk companies. Prompting the DOH to come up with the revised Implementing Rules and Regulations (RIRR) but was contested by the Pharmaceutical and Healthcare Association of the Philippines (PHAP), a group of pharmaceutical and milk companies.
The capability of the Health Sector to fend for itself is never a challenge against multi-national milk companies, lacking funds and workers it failed to combat the powerful advertising and media exposure manifested by the richer and better resourced (PHAP).
The Media being dependent on advertising never regulated any probable violators, furthermore it has to be placed into perspective that the media played a vital role in the promulgation of “Breast-milk substitutes” therefore resulting to the deaths of thousands of infants by airing “Disinformations”.
The Milk Companies never recognized the facts that because of their milk formulas and rabid propagandas it has resulted to thousands of deaths, furthermore the decline of breast feeding practice in the country.
The Chief Justice earlier last week stated that it only has to rule on the constitutionality of the RIRR. It is good to know that the Supreme Court can state it in a matter of factly manner. But who’s going to answer in the deaths of thousands of infants?
Is it the Government? Is it the Health Sector? Is it the Media? or Is it the Milk Companies?
